Information:

A declaration/statement/affidavit is a notarised document whereby a person (declaring party) expresses his/her wish regarding certain legal procedures, situations or formally provides information about his/her own legal status. 

Declarations/statements/affidavits are notarised in all cases where the law expressly so requires, and in any other case where the practice requires a declaration/statement/affidavit to be of greater probative value. 

The most common notarised declarations/statements/affidavits are: 

Declaration/statement/affidavit giving permission for a minor to travel abroad:

Required documents:

  • Identification documents of parents;
  • Child’s identification document: Identity Card for minors over 14 and/or passport;
  • Child’s birth certificate;
  • Parents’ marriage certificate (if the parents’ names in the minor’s birth certificate are different from those on the parents’ identity cards);
  • Identity card of accompanying person (original/copy);
  • Divorce decree/certificate, if parents are divorced;
  • The latest marriage certificate, if parents have remarried;
  • Trip duration and route/destination.

Note: Declarations/statements/affidavits giving permission for a minor to travel abroad will be required even after Romania’s accession to the Schengen Area. Pursuant to Article 30(1)(c) of Law no. 248/2005 on the free movement of Romanian citizens abroad, a minor who holds an individual travel document or an identity card, where applicable, and who travels abroad together with one of his/her parents may leave Romania without the consent declaration/statement/affidavit of the other parent only if the accompanying parent produces proof that he/she was granted custody of that minor by a final (and irrevocable, if applicable) court order or that he/she exercises parental authority alone by virtue of a final (and irrevocable, if applicable) court order. A consent declaration/statement/affidavit is also not required from a parent who has lost parental rights or, where applicable, has been declared missing under the law, if the accompanying person provides proof of this.

Declarations/statements/affidavits for removal of certain rights/notes from the Land Register

Declarations/statements/affidavits on the fulfilment of legal requirements laid down by specific laws, depending on the customer’s request.

 

A power of attorney is a notarised document acknowledging the power and authority granted by a principal to one or more representatives to sign legal documents on behalf and for the account of the principal.

Powers of attorney therefore represent the principal’s wish to delegate certain powers to a third party whom he/she trusts.

The most common notarised powers of attorney are:

Power of attorney for sale of real estate:

Required documents:

  • Identification document of owner;
  • Identification document of authorised person (copy);
  • Civil status documents (copy of marriage certificate, divorce decree/certificate, death certificate of deceased spouse, if applicable);
  • Ownership deeds (land register extracts and documents whereby property was acquired; e.g. sales agreement, donation agreement, personal care agreement, heir certificate, title deed, building permit, acceptance report and building completion certificate);
  • Land register extract.

Note: ther documents may also be requested, depending on the particulars of the document.


Power of attorney for representation in succession procedures:

Required documents:

  • Identification document of principal;
  • Identification document of authorised person (copy);
  • Death certificate of deceased;
  • Civil status documents showing the degree of kinship with the deceased, e.g. birth and marriage certificates (if the principal changed his/her name following the marriage, death certificate)

Power of attorney for vehicle registration:

Required documents:

  • Identification document of owner;
  • Identification document of authorised person (copy);
  • Civil status documents (copy of marriage certificate, divorce decree, death certificate of deceased spouse, if applicable);
  • Documents of origin: sale-purchase agreement, invoice, registration certificate or vehicle identification card

Other powers of attorney: for asset management; for submission or receipt of documents if documents are issued only to their holder in person.

Note: The presence of the authorised person (representative) is not required.
