Copy notarisation:

Notaries public only issue notarised copies of original documents presented by the parties, as the originals were issued initially, after comparing the copy to the original.

In the case of notarised copies of identity documents or travel documents, the purpose for which such copies are to be used will be stated in the notarisation text.

Certified/notarised copies issued from notarial archives are valid for 6 months.

Notarised copies from notary office archives of documents made by a notary public will be issued only to the parties to such documents, their successors and representatives, and to those who prove to have a legitimate right or interest.

In order to have a notarised copy of an original document drawn up in a language other than Romanian, that document needs to be translated into Romanian by a certified translator and interpreter, in accordance with the law.

Signature authentication:

Notaries public may authenticate the signatures of the parties to a document only if the law does not require that document to be made in an authentic form in order to be valid.

For their signatures to be authenticated, the parties will present unsigned copies of the document. The notary public will identify the parties, satisfy himself/herself that the parties are aware of the contents of the document, and then ask them to sign in his/her presence all copies of the document.

At the request of the party, a notary public may authenticate the specimen signature of the person who will be present in person in the notary’s office and sign before the notary public. A common example is preparing a specimen signature document for the purpose of becoming a director of a company.

Legal Advice:

Notaries public may also give legal advice on notarial matters other than on the content of the documents that they prepare and may participate, as specialists appointed by the parties, in the preparation and drafting of legal documents of a notarial nature.
